Marijuana is currently considered a Schedule One drug in the US, meaning it’s in the most dangerous of five categories, more dangerous than even cocaine and methamphetamine, which are both schedule two.

The marijuana growers defense is based on the argument that classifying marijuana as a Schedule One drug is unconstitutional because 23 states have made the drug legal for medical use. Prosecutors say that the drug’s classification is not a matter for the courts, but for congress.

If convicted, the men face up to life imprisonment and a $10 million fine, but if the court finds in favor of the men it could forever change the legal status of marijuana.
