When it comes to the long in-the-works lawsuit from Nebraska and Oklahoma against neighboring state Colorado over that state’s cannabis laws, the U.S. Supreme Court does not give enough fucks to actually hear about it in court.
Specifically, they give two fucks, as two of the Supreme Court justices were down to hear the case. But the remaining six justices did not give fucks and didn’t want to hear about or vote on that shit, so legally the SCOTUS did not give enough fucks to hear the case, according to the Associated Press.
Oklahoma and Nebraska first proposed the lawsuit over a year ago. Their beef with Colorado was that they claimed when Colorado made marijuana recreationally legal and allowed its sale in stories, it caused illegal weed trafficking into Oklahoma and Nebraska to significantly climb, and this put an unfair burden on those states’ police authorities. But the Supreme Court still didn’t give a fuck.
The trend of higher courts not having fucks to give over state cannabis laws is highly promising for the progression of weed legality and tolerance in the U.S.A. The Supreme Court decision comes hot on the trail of other similarly fuck-giveaway-less decisions from other higher courts, as pointed out by The Cannabist. There was the dismissal of a racketeering case against marijuana growers in Pueblo County by a U.S. district judge, a different dismissal by a different district judge of a different but equally asinine case (this one a lawsuit by sheriffs and lawyers in Colorado, Kansas and Nebraska), and yet another dismissal of a RICO suit late last year.
“There’s no question about it: This is good news for legalization supporters,” Tom Angell, chairman of Marijuana Majority, told Cannabist. “This case, if it went forward and the Court ruled the wrong way, had the potential to roll back many of the gains our movement has achieved to date. And the notion of the Supreme Court standing in the way could have cast a dark shadow on the marijuana ballot measures voters will consider this November.”
As for the two fucks that were given by Supreme Court justices, they came from the esteemable Justices Clarence Thomas and Samuel Alito.
“The complaint, on its face, presents a ‘controvers[y] between two or more States’ that this Court alone has authority to adjudicate,” said Thomas. “The plaintiff States have alleged significant harms to their sovereign interests caused by another State. Whatever the merit of the plaintiff States’ claims, we should let this complaint proceed further rather than denying leave without so much as a word of explanation.”
Luckily, six more justices had no fucks to give regarding the case. We’re knocking on wood hoping that whoever takes the late Justice Scalia’s seat on the bench will also give zero fucks about trifling weed lawsuits.
